What documents do I need to check before a subcontractor starts on site?
Under CDM 2015 Regulation 8, principal contractors must verify subcontractor competence before work begins. At minimum, check employers’ liability insurance (statutory requirement), public liability insurance, CSCS cards for each operative, CIS verification status, and relevant trade certifications such as Gas Safe or NICEIC. When SubComply launches, it will track all of these in a single dashboard.
What is the fine for uninsured workers on a construction site?
Employers’ liability insurance is compulsory under the Employers’ Liability (Compulsory Insurance) Act 1969. HSE can issue a fine of up to £2,500 for every day an employer operates without valid EL insurance. Even a few days’ lapse can result in significant penalties from a single inspection.
How does CDM 2015 affect subcontractor management?
CDM 2015 places a duty on principal contractors to plan, manage, and monitor construction work. Regulation 8 specifically requires assessing the skills, knowledge, and experience of every contractor and worker. This means verifying certifications, insurance, and competence records — and keeping evidence that you did so.
What is a CSCS card and who needs one?
The Construction Skills Certification Scheme (CSCS) card confirms that a worker has the right training and qualifications for their role on site. Most major contractors and clients require all operatives, supervisors, and managers to hold a valid CSCS card before accessing site. Cards have expiry dates that need tracking.
What does CIS verification mean for subcontractors?
The Construction Industry Scheme (CIS) requires contractors to verify subcontractors with HMRC before making payments. Verification determines the correct tax deduction rate: 0%, 20%, or 30%. Failing to verify can mean you deduct at the higher rate or face HMRC penalties.
How long should I keep subcontractor compliance records?
HSE recommends keeping health and safety records for at least 40 years for health surveillance, and construction phase plans should be retained for the life of the structure. Insurance certificates should be kept for at least six years (limitation period for civil claims). When SubComply launches, it will store all records with full audit trails.
